However, in no event shall we be liable for any loss or damages including without limitation, indirect or consequential loss or damages, or any loss or damages whatsoever arising from or in connection with the collection, use and retention of personal information unless we are in material breach of or gross negligence in our obligations under this Privacy Agreement or in breach of any privacy laws applicable.
